Terms of Service for TDR Mods

Welcome to TDR Mods (the "Site"). This platform is provided by Luca Pavan (the "Owner", "we", "us", or "our") as a community hub for sharing modifications ("Mods") for games.

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING OUR SITE, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND ALL POLICIES INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THE SITE.

1. Key Definitions

   • "Site" or "Platform": Refers to the website located at https://tdrmods.com/, owned and operated by Luca Pavan.
   • "User": Any person who registers on, accesses, or uses the Site.
   • "Content" or "Mod": Any software, files, textures, 3D models, code, text, images, or other materials uploaded, posted, or shared by a User on the Platform.

2. Role of the Platform and Limitation of Liability

   The Owner provides this Site solely as a hosting platform and technical service provider. We do not create, endorse, or pre-screen the Content uploaded by Users.

   You acknowledge and agree that:

   • The Owner is not responsible for any User-uploaded Content. The legal liability for any Content rests solely with the User who uploaded it.
   • We do not guarantee that the Mods available on the Site are safe, functional, free of errors, viruses, malware, or other harmful components. Downloading and using any Mod is done at your own risk.
   • The Owner shall not be liable for any direct or indirect damages, including but not limited to, damage to your game software, computer, loss of data, or service interruptions, arising from the use or inability to use any Mod downloaded from the Site.

3. User Obligations and Responsibilities

   By creating an account and uploading Content, you represent, warrant, and agree to the following:

   • Intellectual Property: You are the original creator of the Content you upload, or you possess all the necessary licenses, rights, and permissions to use it and distribute it via the Site. It is strictly forbidden to upload material that infringes on third-party copyrights, trademarks, or other intellectual property rights.
   • Prohibited Content: You will not upload, post, or share Content that is: illegal, obscene, defamatory, threatening, pornographic, harassing, hateful, or racially or ethnically offensive; contains viruses or malicious code; violates the privacy of others; or promotes illegal activities.
   • License Granted to the Owner: By uploading a Mod, you grant Luca Pavan a worldwide, non-exclusive, royalty-free, transferable license to use, host, distribute, reproduce, and display the Content for the purpose of operating and promoting the Site.
   • License Granted to Other Users: You grant other Users of the Site a license to download, install, and use your Mod for personal, non-commercial purposes.

4. Content Moderation and Removal

   Although we are under no obligation to monitor Content, we reserve the right, at our sole discretion, to remove any Mod without prior notice that we believe violates these Terms or is otherwise inappropriate or harmful.

5. Copyright Infringement Reporting (Takedown Procedure)

   We respect the intellectual property of others. If you believe that any Content on the Site infringes upon your copyright, please send a notification at hello@lucapavan.dev including all legally required information (e.g., as stipulated by DMCA in the US or similar local regulations).

6. Indemnification

   You agree to defend, indemnify, and hold harmless Luca Pavan from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of the Site; (b) your violation of any term of these Terms of Service; or (c) your violation of any third-party right, including copyright or privacy rights, caused by the Content you upload.

7. Account Termination

   We reserve the right to suspend or terminate your account at any time, for any reason, including for any violation of these Terms, at our sole discretion and without prior notice.

8. Changes to the Terms of Service

   We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting a notice on the Site. Your continued use of the Site after such changes will constitute your acceptance of the new Terms.

9. Governing Law and Jurisdiction

   These Terms shall be governed by and construed in accordance with the laws of the Republic of Italy. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the competent courts of Pordenone, Italy.
